Terms & Conditions of Use for STAMBA Application
1. Introduction
Welcome to STAMBA application, a digital loyalty and rewards platform that connects customers with participating companies.
This application is owned, operated, and developed by Tawaabe Alwalaa Alraqamiyya Company, the legal entity responsible for operating the application and developing its services, represented by the company's legal representative.
Disclaimer: These Terms constitute a legally binding agreement between you and us. Please take the time to read them carefully.
2. Acceptance and Agreement
A. By downloading or installing the STAMBA application, creating an account, clicking the "I Agree" option, or using the application in any way, you explicitly acknowledge and agree that you have read, understood, and is legally bound by these Terms and Conditions. This agreement constitutes a binding contract between you and the Company. You also acknowledge your agreement to our Privacy Policy. If you do not agree, you must immediately cease using the application.
B. You also acknowledge that your continued use of the application after any modification or update to these Terms and Conditions constitutes your explicit acceptance of the modified version.
C. The application is intended for persons aged thirteen (13) years and above. If you are under eighteen (18) years old, you may not use the application except under the supervision and with the consent of your parent or legal guardian. Once a parent or guardian permits the use of the application, they assume full responsibility for such use, including activities performed, data provided, and any resulting consequences.
D. STAMBA company reserves the right to request proof of parental or legal guardian consent at any time and may suspend or cancel the account if such proof is not provided upon request.
3. Data Collection and Use
We may collect and process the following data when using the application:
- Full Name
- Phone Number
- Email Address
- Address and City
- Age and Gender
- Geographic Location Data (when needed)
- Purchase Behaviors (types of products and services, frequency of purchases, average spending and preferences)
Purposes of Use:
- Creating and managing the user account.
- Activating loyalty services, collecting stamps, and redeeming them.
- Communication regarding offers, rewards, and updates.
- Analyzing customer behavior to improve the service.
- Sharing data with participating companies to enable them to operate their loyalty programs.
4. Data Ownership and Sharing
- All data collected through the application is the exclusive property of the STAMBA Company.
- Participating companies are entitled to access and use the data only during their subscription period.
- Upon termination of the subscription, the company's right is limited to a final statistical report for the campaigns it executed.
- Companies may not claim or use the data after the relationship ends.
- STAMBA does not sell user data to any external party not related to the service.
5. Responsibility for Rewards and Participating Companies
- All rewards, gifts, and services are managed exclusively by the participating companies.
- STAMBA bears no responsibility for the quality, availability, or delivery of any rewards.
- All terms of loyalty cards (number of stamps, nature of rewards, redemption conditions) are determined by the participating companies.
- Any dispute regarding rewards or services is handled directly with the service-providing company.
6. User’s Obligations
- The user is obligated to enter accurate and complete data.
- It is prohibited to use the application for any illegal or fraudulent activity.
- STAMBA has the right to suspend or terminate the account in case of a breach of the Terms.
- The user bears full responsibility for the confidentiality of login credentials.
7. Security and Privacy
- STAMBA employs technical and organizational measures to protect personal data.
- Nevertheless, the user acknowledges that the internet is not a completely secure environment and that STAMBA does not guarantee absolute protection.
- The user has the right to request access to, correction, or deletion of his data in accordance with applicable legislations.
8. Confidentiality (NDA)
- Participating companies are committed to maintaining the confidentiality of any data accessed through the platform.
- It is strictly prohibited to share, disclose, or use data outside the scope of the service.
- Any breach of confidentiality grants STAMBA the right to terminate the subscription immediately and claim compensation.
9. Intellectual Property
- All intellectual property rights of the application, including the trademark, design, content, codes, and software, belong exclusively to STAMBA.
- No part of the application may be reproduced, modified, or distributed without prior written permission from STAMBA.
10. Account Management and its Termination
- The user has the right to request the closure of its account at any time.
- STAMBA has the right to suspend or cancel any account proven to be in violation of the Terms.
- Upon account termination, the user's data will be deleted or anonymized in accordance with the privacy policy.
11. Notices and Communications
- The user agrees that all notices or updates may be sent via email or through application notifications.
- These notices are considered received upon sending.
12. Permitted Age
- The application is intended for users aged 13 years and above.
- For minors, the responsibility for use lies with parents or/and legal guardians.
13. User Content and License
The application may allow users to upload, enter, or share content, including but not limited to text, images, reviews, or any other materials ("User Content"). By submitting User Content, you grant STAMBA a global, non-exclusive, royalty-free, transferable license to use, reproduce, display, distribute, and modify this content solely for the purpose of operating, improving, and promoting the application and its related services.
You acknowledge and warrant that you own or have obtained all necessary rights to the User Content you provide and that this content does not infringe any third-party rights.
You agree not to upload, share, or transmit any illegal, abusive, defamatory, obscene, harassing, discriminatory, or otherwise harmful content. STAMBA reserves the right to remove any User Content that violates these Terms or applicable laws without prior notice.
14. Indemnification
You agree to indemnify, defend, and hold harmless STAMBA, its affiliates, officers, employees, partners, and representatives from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from or related to:
- Your use or misuse of the application.
- Any breach of these Terms and Conditions; or
- Any violation of applicable laws or third-party rights.
This indemnification obligation continues after the termination or suspension of your account or your cessation of using the application.
15. Limitation of Liability
- STAMBA shall not be liable for any direct or indirect damage resulting from the use of the application.
- Full responsibility for the quality of products and services lies with the participating companies.
- The STAMBA application and all services, rewards, and offers available through it are provided on an "as it is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- STAMBA does not guarantee that the application will be continuously available, error-free, secure, or free from viruses or other harmful components. The user acknowledges that occasional interruptions, delays, or technical issues may occur due to factors beyond the company's control (including internet outages, technical malfunctions, or force majeure events).
- The rewards, offers, and discounts provided by the application are determined exclusively by the participating companies, are subject to availability, and may be modified, suspended, or withdrawn at any time without prior notice. STAMBA assumes no obligation to guarantee the continuity, quality, or delivery of any of these rewards or offers.
- STAMBA expressly disclaims liability for any damages arising from the use of the application, reliance on any offers, or unavailability of services, except in cases where liability cannot be excluded under applicable law.
16. Modifications
- STAMBA reserves the right to modify or update these Terms at any time.
- Users will be notified of material changes via email or application notifications.
- Continued use after modifications constitutes implicit acceptance of the revised Terms.
17. Assignment of Rights and Obligations
STAMBA may assign, transfer, or delegate any of its rights or obligations under these Terms and Conditions, as a whole or in part, to any third party, including in the event of a merger, acquisition, or restructuring. You may not assign or transfer your rights or obligations arising from these Terms without obtaining prior written consent from STAMBA, and any unauthorized assignment shall be null and void.
18. Cookies and Tracking
The application may use cookies, tracking technologies, or analytics tools to improve the user experience, enhance service performance, and provide personalized offers. By using the application, you acknowledge and agree to the use of these technologies as outlined in our Privacy Policy. You can manage or disable cookies through your device settings; however, some application features may not function correctly if they are disabled.
19. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute, controversy, or claim arising out of or in connection with the use of the STAMBA application, or its validity, interpretation, or performance, shall be referred to arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The number of arbitrators shall be one (1), the seat of arbitration shall be London, United Kingdom, the language of the arbitration shall be English, and the arbitral award shall be final and binding upon the parties.
